{"id":130,"date":"2021-11-08T14:50:27","date_gmt":"2021-11-08T01:50:27","guid":{"rendered":"https:\/\/ship2u.hosting.retech.nz\/?page_id=130"},"modified":"2021-11-08T14:50:28","modified_gmt":"2021-11-08T01:50:28","slug":"terms-conditions","status":"publish","type":"page","link":"https:\/\/ship2u.hosting.retech.nz\/?page_id=130","title":{"rendered":"Terms &#038; Conditions"},"content":{"rendered":"\n<p>1 Introduction<\/p>\n\n\n\n<p>1.1 www.ship2u.co.nz (the Site) is operated by Aion Technologies Limited (we, us and our). We are registered company in New Zealand.<\/p>\n\n\n\n<p>1.2 The terms contained in this Terms &amp; Conditions document (T&amp;C) apply to all transactions for the purchase of Services (as defined in condition 2.1 below).<\/p>\n\n\n\n<p>1.3 In order to use the Services you must become a registered member of the Site (Member) by following the instructions on the Site. Please read these T&amp;C carefully before you become a member.<\/p>\n\n\n\n<p>1.4 This T&amp;C is not negotiable and therefore binding on both parties once we accept your shipment. Thus, by dropping off your shipment with us or sending your shipment to us or authorizing us to pick up your shipment, you agree to all the T&amp;C herein contained. It sets forth the rights, duties and obligations and in certain cases liabilities of parties having interest in any shipment.<\/p>\n\n\n\n<p>1.5 You also agree and acknowledge that we reserve the right, at our sole discretion to change or modify these T&amp;C at any time. Any change will not affect the provision of Services in relation to any order that you place or Goods that we receive on your behalf from a Supplier (each as defined in condition 2.1.1 below) before that change is implemented.<\/p>\n\n\n\n<p>1.6 Please review these T&amp;C periodically, especially before sending your shipment, as your use of our service each time constitutes an acceptance of any modified T&amp;C.<\/p>\n\n\n\n<p>2 Registration<\/p>\n\n\n\n<p>2.1 We offer the following services (the Services):<\/p>\n\n\n\n<ul><li>Forwarding Service<\/li><\/ul>\n\n\n\n<p>2.1.1 Whenever you arrange for goods (Goods) to be sent to the unique Ship2U address when you became a Member (My Ship2U Address), we will forward those Goods to your Delivery Address (the Forwarding Service). You may arrange for Goods to be sent to your Ship2U Address in the following ways:<\/p>\n\n\n\n<ul><li>by placing an order directly with a supplier (Supplier), specifying your Ship2U Address as the delivery address for the Goods; or<\/li><li>by way of the Personal Shopper Service (described in condition 2.2 below)<br>We will charge you a fee for using the Forwarding Service (the Shipping Fee) which, if the Goods arrived at your Ship2U Address by way of the Personal Shopper Service, must be paid in addition to the Personal Shopper Service Fee (as applicable). The amount of the Forwarding Fee will be agreed with you when we contact you by text to arrange the forwarding of your Goods to your Delivery Address. As soon as we receive full payment of the entire Fee from you (as defined in condition 8.2 below), we will dispatch the Goods to your Delivery Address.<\/li><li>Personal Shopper Service<\/li><\/ul>\n\n\n\n<p>2.1.2 The Personal Shopper Service is available to all members.<br>If you are a member, you may, subject to condition 4, place an order with us requesting that we, as your agent, place an order with a Supplier for specific Goods on your behalf. We will pay the Supplier for those Goods and arrange for their delivery to your Ship2U Address.<br>We will charge you a fee for using the Personal Shopper Service (the Personal Shopper Fee). You must pay the full price of the Goods and the Personal Shopper Service Fee before we can place any order with the Supplier. After we have received the Goods at your Ship2U Address, we will contact you by text to arrange the forwarding of those Goods to your Delivery Address using the Forwarding Service.<\/p>\n\n\n\n<p>3 Using the Services<\/p>\n\n\n\n<p>The terms set out in this condition 3 apply to all Services that we offer.<\/p>\n\n\n\n<p>3.1 If you place an order for Goods directly with a Supplier, you must provide your Ship2U Address as the address to which the Supplier should send those Goods.<\/p>\n\n\n\n<p>3.2 We are only able to receive Goods during business working hour. When you place an order for Goods directly with a Supplier, you will need to tell the Supplier this. We will not be liable to you for any Goods delivered outside those hours.<\/p>\n\n\n\n<p>3.3 Acceptance of your request for us to provide Services to you in accordance with these T&amp;C shall take place:<\/p>\n\n\n\n<p>3.3.1 if you placed an order directly with a Supplier specifying your Ship2U Address as the delivery address for the Goods, when we dispatch your Goods to your Delivery Address by way of the Forwarding Service; or<\/p>\n\n\n\n<p>3.3.2 if you are using the Personal Shopper Service, when we have received the full price payable for the Goods and the Personal Shopper Service Fee for those Goods<\/p>\n\n\n\n<p>3.4 Subject to conditions 3.2 and 3.3 above, risk in the Goods will pass to us on the date we receive the Goods. Risk in the Goods will pass to the Courier (as defined in condition 3.6 below) on the date we pass the Goods to the Courier.<br>Title in the Goods will pass in accordance with the following:<\/p>\n\n\n\n<ul><li>Order Placed with Supplier<\/li><\/ul>\n\n\n\n<p>3.4.1 title in the Goods shall remain with the Supplier until you make payment in full for those Goods to the Supplier, at which point title will pass to you.<\/p>\n\n\n\n<ul><li>Personal Shopper Service<\/li><\/ul>\n\n\n\n<p>3.4.2 title in the Goods shall remain with the Supplier until we make payment in full for those Goods on your behalf, at which point, provided we have already received payment in full for those Goods from you, title will pass to you.<\/p>\n\n\n\n<p>3.5 After we have received the Goods we will process them through our warehouse. While processing the Goods through our warehouse we may need to inspect the Goods, which could include opening packages where necessary. If we do this, we will re-package the Goods so they are packaged to a similar standard to when we received them. Although we will use reasonable endeavours to avoid doing so, you acknowledge that as part of this inspection we may have to break the seals on some Goods. We do not accept any liability for any damage caused as a result (unless it is due to our negligence).<\/p>\n\n\n\n<p>3.6 All Goods will be delivered to your Delivery Address by way of the Forwarding Service by a courier appointed by us (the Courier).<\/p>\n\n\n\n<p>3.7 In certain limited circumstances (such as where we receive Prohibited Goods or Restricted Goods, as defined in conditions 5.1) we may, where we think it is reasonable, refuse to provide the Services in relation to Goods we receive from a Supplier. If this happens we will return the Goods to that Supplier and the cost of the returning Goods will be handed over to you.<\/p>\n\n\n\n<p>4 Personal Shopper Service<\/p>\n\n\n\n<p>This condition 4 shall govern the Personal Shopper Service described in condition 2.1.2.<\/p>\n\n\n\n<p>4.1 The Personal Shopper Service Fee is set out on the Site and is in addition to the Forwarding Fee.<\/p>\n\n\n\n<p>4.2 When placing an order for the Personal Shopper Service you must provide us with the following product information so that we may process your order:<\/p>\n\n\n\n<ul><li>Product Name;<\/li><li>URL link to the item on the website of your nominated Supplier;<\/li><li>Unit Price;<\/li><li>Quantity;<\/li><li>Retailer Name;<\/li><li>Option (Color, Size, &amp; etc);<\/li><\/ul>\n\n\n\n<p>4.3 We may refuse to accept any order placed by you for the Personal Shopper Service in our absolute discretion (including, without limitation, where the Goods do not comply with the requirements set out in these T&amp;C).<\/p>\n\n\n\n<p>4.4 When placing an order for us to provide the Personal Shopper Service, you:<\/p>\n\n\n\n<p>4.4.1 acknowledge that if we place an order on your behalf we do so as your agent;<\/p>\n\n\n\n<p>4.4.2 acknowledge that we do not accept any liability in relation to any Goods we order, except to the extent expressly set out in these T&amp;C and that, if the Goods are faulty, you will contact the Supplier and\/or manufacturer of the Goods directly and not us; and<\/p>\n\n\n\n<p>4.4.3 agree that we may, at our option, obtain identical Goods from an alternative Supplier to your nominated Supplier (provided that the price charged by that alternative Supplier is the same or less than the price charged by your nominated Supplier). We are not required to pass on to you any cost savings or commission we gain as a result of obtaining the Goods from an alternative Supplier in this way.<\/p>\n\n\n\n<p>4.5 By placing an order for the Personal Shopper Service, we will assume that you also wish us to provide the Forwarding Service as set out in these T&amp;C.<\/p>\n\n\n\n<p>4.6 Before we can accept your order for the Personal Shopper Service, we will contact your nominated Supplier to confirm the correct price of the Goods and their availability. If the Goods can only be sourced with that Supplier at a higher price than you have specified, we will try to identify an alternative Supplier in accordance with condition 4.5.3 above. If we are unable to identify an alternative Supplier, we will contact you to confirm (a) the price at which the Goods may be sourced from your nominated Supplier; and (b) the identity of an alternative Supplier and the price at which identical Goods may be sourced from that Supplier. We will not place any order with an alternative Supplier until you have confirmed to us that you are happy for us to do so. If the Goods are unavailable, we will notify you and cancel your order.<\/p>\n\n\n\n<p>4.7 We must receive the full price payable for the Goods together with the Personal Shopper Service Fee before we can accept your order. We will, in our discretion either:<\/p>\n\n\n\n<p>4.7.1 require you to pay the price payable for the Goods and the Personal Shopper Service Fee at the time you place your order (this amount will be refunded if we do not accept your order); or<\/p>\n\n\n\n<p>4.7.2 send you an invoice by e-mail for the price payable for the Goods and the Personal Shopper Service Fee.<\/p>\n\n\n\n<p>4.8 Following receipt of the full price payable for the Goods and the Personal Shopper Service Fee, we will place an order for the Goods as soon as reasonably practicable.<\/p>\n\n\n\n<p>5 Restrictions on your use of the Services<\/p>\n\n\n\n<p>5.1 You must not arrange for any Goods to be sent to us, or place an order for any Goods with us, where those Goods:<\/p>\n\n\n\n<p>5.1.1 may be hazardous or dangerous;<\/p>\n\n\n\n<p>5.1.2 are not permitted for carriage by air or sea;<\/p>\n\n\n\n<p>5.1.3 cannot lawfully be delivered to the jurisdiction in which the Delivery Address is located; or<\/p>\n\n\n\n<p>5.1.4 are listed in condition 11 of these T&amp;C (or otherwise notified to you by us from time to time or set out on the Site) (Prohibited Goods).<\/p>\n\n\n\n<p>5.2 Save as provided in condition 5.1, in no circumstances will we accept any order for Prohibited Goods or Restricted Goods. If you are unsure if any Goods are Prohibited Goods or Restricted Goods, please contact us by email at help@ship2u.co.nz or telephone on +64 (0) 9 254 4900 before placing your order with the Supplier or, in the case of the Personal Shopper, with us.<\/p>\n\n\n\n<p>5.3 If Prohibited Goods or Restricted Goods are sent to us:<\/p>\n\n\n\n<p>5.3.1 we will deal with them as we see fit which may include disposal (and will charge you for any costs and expenses we incur); or<\/p>\n\n\n\n<p>5.3.2 if you want us to return the Goods to the Supplier, you will be responsible for the cost of the return. (and will charge you for any costs and expenses we incur); or<\/p>\n\n\n\n<p>5.3.3 you will indemnify us and keep us and our employees, sub-contractors and agents indemnified against any and all resulting losses, damage and\/or injuries.<\/p>\n\n\n\n<p>5.4 You must not use your Ship2U Address, including declaring it as your residential address, in the application for, renewal of or replacement of any official documents or for the registration of any business, partnership or company. This includes but is not limited to using your Ship2U Address in driving licenses, passports or certificates of incorporation. We will not forward official documents to you and will dispose of them as we see fit.<\/p>\n\n\n\n<p>5.5 You must not apply for credit, mortgages or loans using your Ship2U Address.<\/p>\n\n\n\n<p>5.6 You must not provide your Ship2U Address as your address to any governmental, regulatory, legal or financial organisation.<\/p>\n\n\n\n<p>5.7 The Services are intended only to facilitate the purchase of goods and the receipt and forwarding of goods as described in these T&amp;C. Any other use of the Services or your Ship2U Address must be explicitly agreed by us in writing and in advance. For example the Services do not include forwarding correspondence received at your Ship2U Address.<\/p>\n\n\n\n<p>5.8 Unless they are faulty, incorrect or damaged we will not return the following types of goods to retailers without prior written agreement: any goods that the original seller will not accept on return. Furthermore, in all circumstances, we will not return goods if by doing so we believe it may harm our reputation or business. (For example because you have ordered a lot of goods with the intention of reselling them but having been unable to you wish to return them. We will not facilitate that type of activity.)<\/p>\n\n\n\n<p>6 International deliveries<\/p>\n\n\n\n<p>6.1 You authorise us to complete any necessary documentation for the purpose of customs clearance (where we are legally permitted to do so).<\/p>\n\n\n\n<p>6.2 Goods you require us to send through the Services may be subject to import duties and taxes. You will be responsible for these. We have no control over such charges and cannot advise you as to what they may be. We will pay any duty or GST to Customs on your behalf and then bill you. All of these charges must be paid prior to goods being delivered to you.<\/p>\n\n\n\n<p>6.3 You will be regarded as the importer of any Goods that we send to you through the Services and it is your responsibility to comply with all laws and regulations of the country in which the Goods are to be delivered. Such Goods may be subject to opening and inspection by customs authorities.<\/p>\n\n\n\n<p>7 Delivery and Storage<\/p>\n\n\n\n<p>7.1 We will aim to ensure that all Goods which we receive at your Ship2U Address are forwarded to your Delivery Address (by way of the Forwarding Service) as soon as possible after receiving your Forwarding Service request and payment to do so.<\/p>\n\n\n\n<p>7.2 We may, prior to dispatching the Goods to your Delivery Address (by way of the Forwarding Service) and in our discretion, contact you to offer you the option of receiving the Forwarding Service by way of a low cost or pallet based service as opposed to a normal Courier. Where you agree to receiving the Forwarding Service in this way, we will agree with you an alternative Forwarding Fee before we dispatch the Goods to your Delivery Address. When using this low cost or pallet based service, your delivery time should not exceed 30 business days. We will not accept any liability for the loss, damage or destruction of Goods after they have been delivered to you.<\/p>\n\n\n\n<p>7.3 We will store Goods which we receive at your Ship2U Address for up to 30 days without charge whilst we await your instructions to ship and your payment for the Forwarding Service. After this time we will charge a daily storage fee for each package we have stored beyond 30 days ($0.50 p\/day). The fee for each package will accrue daily until the package is shipped or disposed of. The fee we charge for storage is set out on the Site or in an email we send you before the charge is incurred.<\/p>\n\n\n\n<p>7.4 We will store Goods for up to 180 days and after this time we will dispose the package.<\/p>\n\n\n\n<p>8 Prices and payment<\/p>\n\n\n\n<p>8.1 Before you place an order with a Supplier for delivery to your Ship2U Address, we suggest that you use the calculator on the Site to obtain an indicative price for us providing the Forwarding Service to you.<\/p>\n\n\n\n<p>8.2 The full fee that you must pay to us for each order (the Fee) shall comprise:<\/p>\n\n\n\n<p>8.2.1 the cost of the Goods ordered (which shall be zero where you have placed an order directly with a Supplier and have already paid the Supplier for those Goods); and<\/p>\n\n\n\n<p>8.2.2 the Personal Shopper Fee (if applicable); and<\/p>\n\n\n\n<p>8.2.3 the Forwarding Fee agreed with you.<\/p>\n\n\n\n<p>8.3 The Personal Shopper Fee shall each be set out on the Site from time to time.<\/p>\n\n\n\n<p>8.4 The Forwarding Fee will be agreed with you before we send the Goods to your Delivery Address. The Forwarding Fee will be dependent upon (i) the charges made by the Courier and (ii) the size and weight of the package as measured and determined by us when we receive the Goods from the Supplier at your Ship2U Address.<\/p>\n\n\n\n<p>8.5 All prices on the Site are in New Zealand dollars ($). Prices may change at any time without any notification.<\/p>\n\n\n\n<p>8.6 Whenever we receive Goods at your Ship2U Address, we will contact you using the details you provided when you became a Member to confirm the full amount of the Fee. If we are unable to contact you in order to make a Payment, or you are unable to make a Payment for any reason, we will promptly send to you an e-mail invoice for the amount of the Fee (an Invoice Payment). For the avoidance of doubt, we will not dispatch the Goods to you until we have received full payment for the Goods and the entire Fee.<\/p>\n\n\n\n<p>8.7 If we are unable to contact you or receive payment within 180 days of receiving Goods from a Supplier at your Ship2U Address, we will dispose the package.<\/p>\n\n\n\n<p>8.8 You are responsible for the Courier\u2019s costs where:<\/p>\n\n\n\n<p>8.8.1 we return any Goods to the Supplier; or<\/p>\n\n\n\n<p>8.8.2 any Goods are returned to us because you are not available or refuse to accept delivery of those Goods at the Delivery Address on the date of attempted delivery by the Courier.<\/p>\n\n\n\n<p>8.9 Where, under condition 8.10 above, you are required to pay Courier costs, we will contact you so you may make a Payment for those costs.<\/p>\n\n\n\n<p>8.10 All payment card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment we will not be able to send your Goods, will not be obliged to inform you of the reason for the refusal and we will not be liable for non-delivery. In these circumstances we will try to contact you again to obtain valid payment details. If you do not provide a successful Payment promptly we will deal with the Goods as we see fit.<\/p>\n\n\n\n<p>8.11 We are not responsible for your card issuer or bank charging you as a result of our processing of your Direct Payment.<\/p>\n\n\n\n<p>8.12 All payment transactions will be processed on our behalf by our nominated payment merchant. This means that your credit\/debit card details are provided directly to the payment merchant and are never revealed to us. The payment merchant shall operate a secure server to process your payment details. The payment merchant shall encrypt your credit\/debit card information and shall authorise payment.<\/p>\n\n\n\n<p>9 Our liability and optional insurance<\/p>\n\n\n\n<p>9.1 Subject to the remaining provisions of this condition 9, in relation to each consignment of Goods we receive from a Supplier or order on your behalf by way of the Personal Shopper Service, our liability to you in contract, tort (including negligence), breach of statutory duty or otherwise shall not exceed the lesser of the:<\/p>\n\n\n\n<p>9.1.1 repair or replacement cost of the Goods contained in that consignment;<\/p>\n\n\n\n<p>9.1.2 liability of the Courier to us in relation to the Goods contained in that consignment; and<\/p>\n\n\n\n<p>9.1.3 $250.00 (Two hundred fifty dollars).<\/p>\n\n\n\n<p>9.2 Where you have indicated that you would like a consignment of Goods to be insured whilst it is in the care of the Courier, we will arrange for our insurance policy to cover those Goods. The insurance will be provided to us by a third party insurer.<\/p>\n\n\n\n<p>9.3 Where you place an order with a Supplier for delivery to your Ship2U Address, it is your responsibility to ensure that the Supplier is given the correct Ship2U Address. We shall not be responsible for any incorrectly labelled deliveries of Goods. We shall only arrange for our insurance policy to cover Goods where you have indicated in the format of your Ship2U Address or when placing your order that insurance is required. We cannot be held liable for any mistakes in labelling made by the Supplier.<\/p>\n\n\n\n<p>9.4 The cost of taking out any such insurance will include our administration fee for arranging that insurance. That administration fee, and the overall cost of taking out such insurance please contact Ship2U customer service team. If you indicate on the Site that you have read and agree these T&amp;C, you will also indicate that you have read and agree the insurance policy&#8217;s Policy Summary and Insurance Conditions, each of which may be amended from time to time. It is your responsibility to check the terms of the insurance set out in those documents (including the specific exclusions) and to make sure that your Goods are adequately protected under the policy. If there are any material facts and circumstances relevant to the insurance cover, you should notify us of them immediately after placing your order with the Supplier. You may request that we cancel the insurance at any time before the collection of your Goods from us by the Courier.<\/p>\n\n\n\n<p>9.5 If you would like us to make a claim on the insurance policy on our behalf, you should notify us within 7 days. If the claim is make after 7 days we will be not responsible for any loss or damage to your items. We will then make a claim on our policy on your behalf within the 10 day period under the policy. You will be required to cooperate fully with us, and any person appointed by the insurer or Courier, in respect of the claim.<\/p>\n\n\n\n<p>9.6 If the claim is rejected by the insurer, you agree that we shall have no liability to you in respect of that claim.<\/p>\n\n\n\n<p>9.7 The option to repair, replace or compensate you for lost or damaged Goods is at our discretion.<\/p>\n\n\n\n<p>9.8 Nothing in this Agreement will limit or exclude our liability to you for death or personal injury resulting from our negligence, fraud or fraudulent misrepresentation.<\/p>\n\n\n\n<p>10 Claims<\/p>\n\n\n\n<p>Ship2U make every effort to ensure your parcel arrives in good condition, but unfortunately sometimes things can go wrong. This section sets out what compensation is payable for loss of, or damage to, an item, which items are not covered by compensation or cannot be sent and how to make a compensation claim.<\/p>\n\n\n\n<p>10.1 Claims Deadline \u2013 You need to let us know within 7 days of delivery for damage queries and 14 days of dispatch for loss queries. If you do not contact us within these timeframes we will be unable to accept your claim.<\/p>\n\n\n\n<p>10.2 Who Should Make the Claim \u2013 Our member must be the person making contact with customer services, not the receiver.<\/p>\n\n\n\n<p>10.3 Maximum Claim Limit \u2013 Our maximum claim value is $250.00 per shipment including GST, regardless of the value of the goods.<\/p>\n\n\n\n<p>10.4 Items We Don\u2019t Accept Claims On \u2013 We are not liable to pay compensation for loss of, or damage to, an item considered &#8216;High Risk Items&#8217;. If you send these items through our network it is done at your own risk, you will not be able to make a claim for them if something happens.<\/p>\n\n\n\n<p>Examples of high risk items are:<\/p>\n\n\n\n<ul><li>Bullion, cash, coins<\/li><li>Dangerous Goods<\/li><li>Negotiable instruments (such as vouchers)<\/li><li>Perishable items<\/li><li>Securities or bearer securities<\/li><li>Credit cards, uncrossed cheques, traveller\u2019s cheques<\/li><li>Fragile goods, particularly glass<\/li><li>Passports<\/li><li>Second hand car parts<\/li><li>Antiques, paintings, or any works of art<\/li><li>Precious stones, jewellery<\/li><li>Stocks, bonds<\/li><\/ul>\n\n\n\n<p>10.5 Claims on Second Hand Goods \u2013 If a claim is made for second hand goods, you will be entitled to claim for the depreciated value of the goods (not the cost of a brand new item), excluding items which we don\u2019t carry such as the examples given in the above section.<\/p>\n\n\n\n<p>11 Making a claim &#8211; The Claims Process<\/p>\n\n\n\n<p>We have two general categories for claims, \u2018Missing Items\u2019 and \u2018Damaged Items\u2019. If an item fails to reach its destination and we cannot find it, we begin our \u2018Loss Claims\u2019 process (Section One).<\/p>\n\n\n\n<p>If an item arrives at its destination damaged and you feel it is our fault then please refer to our \u2018Damage Claims\u2019 process (Section Two).<\/p>\n\n\n\n<p>If either of these processes find that it is appropriate for us to offer compensation, a member of our Claims Department will take you through the \u2018Claims Process\u2019 (Working out Compensation &#8211; Section Three).<\/p>\n\n\n\n<p>11.1 Section 1 &#8211; If an item fails to reach its destination: The &#8216;Loss Claims&#8217; process<\/p>\n\n\n\n<p>11.1.1 Inform us that a shipment has bnot been delivered (within 10 days of despatch)<\/p>\n\n\n\n<p>11.1.2 We undertake an investigation to determine what happened<\/p>\n\n\n\n<p>11.1.3 If the shipment is not located, and it is within the valid time frame, the query will be forwarded to the Claims Department.<\/p>\n\n\n\n<p>11.2 Section 2 &#8211; If an item arrives damaged : The \u2018Damage Claims\u2019 process<\/p>\n\n\n\n<p>Please note: Ship2U require the item to be returned in its original packaging directly from the receiver to determine how the damage could have occurred.<\/p>\n\n\n\n<p>11.2.1 Inform us that a consignment has been damaged (within 7 days of delivery)<\/p>\n\n\n\n<p>11.2.2 We will arrange the return of the goods to the Ship2U warehouse<\/p>\n\n\n\n<p>11.2.3 If the goods are salvageable or repairable, they will be returned to you for assessment<\/p>\n\n\n\n<p>11.2.4 Once the appropriate course of action has been determined, we will pass this on to our Claims Department to begin the Claims Process<\/p>\n\n\n\n<p>11.3 Section 3 &#8211; Working out compensation: The Claims Process<\/p>\n\n\n\n<p>11.3.1 Once either the \u2018Loss Claims\u2019 process investigation or \u2018Damage Claims\u2019 process investigation has been worked through, our Claims Department will start the \u2018Claims Process\u2019 by sending you an e-mail.<\/p>\n\n\n\n<p>11.3.2 This e-Mail will ask you to supply us with the following information:<\/p>\n\n\n\n<ul><li>A copy of the evidence of contents value &#8211; As Evidence of value for the contents we require either a copy of the original purchase receipt for the contents<\/li><li>A copy of the bank\/credit card statement which validates the purchases for the contents.<\/li><li>A copy of your bank account details<\/li><\/ul>\n\n\n\n<p>11.3.3 Once we have these documents we will process them and, depending on our investigations, inform you whether the claim is accepted or declined as soon as possible. If you have any queries or concerns at all during this process, please feel free to contact a member of our Claims Team who will be happy to help.<\/p>\n\n\n\n<p>11.4 If compensation for damage to an item has been paid in full, then the item will become ours and we may dispose of the damaged item as we choose.<\/p>\n\n\n\n<p>11.5 If we pay you compensation in full for a lost item and the item later turns up, the item will be our property. If you want to have the item returned to you, you must refund us the compensation payment you received in full.<\/p>\n\n\n\n<p>12 General<\/p>\n\n\n\n<p>12.1 We may engage agents and\/or sub-contractors to perform all or any part of the Services and such agents and\/or sub-contractors (including Couriers) will be entitled to the protection of all the terms in these T&amp;C which exclude or limit our liability.<\/p>\n\n\n\n<p>12.2 Any formal legal notices should be sent to us at the address by email and confirmed by post.<\/p>\n\n\n\n<p>12.3 Failure by us to enforce a right does not result in waiver of such right. You may not assign or transfer your rights under these T&amp;C.<\/p>\n\n\n\n<p>12.4 If any part of these T&amp;C is found to be unenforceable as a matter of law, all other parts of these T&amp;C shall be unaffected and shall remain in force.<\/p>\n\n\n\n<p>12.5 You and we agree that New Zealand law applies to these T&amp;C and that any dispute between us arising out of or in connection with these T&amp;C will only be dealt with by the New Zealand courts.<\/p>\n\n\n\n<p>12.6 Nothing in these T&amp;C is intended to, nor shall be deemed to, establish any partnership or joint venture between you and us, constitute any party the agent of the other party, nor authorise any party to make or enter into any commitments for or on behalf of the other party except as expressly provided in conditions 2.1.2.<\/p>\n\n\n\n<p>13 Prohibited Goods<\/p>\n\n\n\n<p>The following items are classified as Prohibited Goods or Dangers Goods:<\/p>\n\n\n\n<ul><li>Aerosols<\/li><li>Bullion<\/li><li>Clinical and medical waste<\/li><li>Explosives, fireworks, munitions, flares, Christmas crackers, sparklers, party poppers and pyrotechnics<\/li><li>Security-type cases\/boxes incorporatingrngoods such as lithium batteries or pyrotechnics<\/li><li>Compressed gases (flammable, non-flammable,rnor poisonous) such as butane, propane, aqualung cylinders, lighter fuels, orrnrefills<\/li><li>Lighters (butane, absorbed fuel, electric,rnbattery-powered, novelty)<\/li><li>Oxidising substances such as bleachingrnpowder and peroxides<\/li><li>Flammable liquids such as paints andrnadhesives<\/li><li>Flammable solids such as safety matches andrnarticles which are easily ignited<\/li><li>Disabling devices such as mace or pepperrnsprays, with irritant properties<\/li><li>Poisons such as arsenic, cyanides, orrninsecticides<\/li><li>Radioactive materials<\/li><li>Corrosive materials such as mercury (whichrnmay be contained in thermometers or blood pressure gauges,) acids, alkalis, andrnwet cell batteries<\/li><li>Meals-Ready-to-Eat (MREs)<\/li><li>Firearms \/ parts of firearm such asrnrevolvers, rifles, imitation firearms, pellet guns, ball-bearing guns, barrels,rntrigger assembly etc<\/li><li>Ammunition including blank, spent \/ emptyrncartridges<\/li><li>Toys guns\/gun shaped items or look-alike<\/li><li>Any other substances which, during arnflight, present a danger not covered above, such as magnetised, offensive, orrnirritating materials<\/li><li>Counterfeit currency, bank notes and postage stamps<\/li><li>Counterfeit goods<\/li><li>Currency<\/li><li>Drugs &#8211; including all over-the-counter, prescription and legal drugs as well as illegal drugs \/ narcotics<\/li><li>Dry Ice<\/li><li>E-cigarettes and other battery-powered portable electronic smoking devices<\/li><li>Environmental Waste<\/li><li>Explosives and ammunition<\/li><li>Flammable liquids &amp; Flammable solids<\/li><li>Furs<\/li><li>Gases<\/li><li>Growth hormone (human or animal)<\/li><li>Human remains<\/li><li>Indecent, obscene or offensive material<\/li><li>Infectious Substances<\/li><li>Legal or illegal highs<\/li><li>Living creatures<\/li><li>Living plants or organisms<\/li><li>Lottery tickets<\/li><li>Matches of any kind<\/li><li>Official documents (e.g. Passport, Driving license, Certificate of Incorporation, etc.) including both genuine and fake documents<\/li><li>Oxidising substances and organic peroxide<\/li><li>Pathogens<\/li><li>Perfumes and Aftershaves<\/li><li>Pesticides<\/li><li>Poisonous (toxic) and infectious substances<\/li><li>Poisons<\/li><li>Pornography<\/li><li>Precious metals and stones<\/li><li>Printer Cartridges<\/li><li>Radioactive materials<\/li><li>Real or imitation firearms, parts thereof<\/li><li>Sharp Instruments<\/li><li>Solvent-Based Paints and Inks<\/li><li>Tobacco and tobacco products<\/li><li>Unidentified substances or items that in our opinion could be any of the other items on this list<\/li><li>Water-Based Paints and Inks<\/li><\/ul>\n\n\n\n<p>**This T&amp;C was last modified on 02nd March 2018.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>1 Introduction 1.1 www.ship2u.co.nz (the Site) is operated by Aion Technologies Limited (we, us and our).
